CNN —An attorney defending Texas’ controversial immigration law told a federal appeals court on Wednesday that state legislators may have gone “too far” when they passed the law last year. The law, known as SB4, makes entering Texas illegally a state crime and allows state judges to order immigrants to be deported. Nielson sought to downplay how sweeping the law was and argued it did not interfere with federal authority on immigration. An attorney for the Justice Department, which brought one of the lawsuits challenging the Texas statute, urged the appeals court not to depart from its previous ruling blocking the law. “Of course, we know that presidents come and go, and different administrations might very well enforce federal law differently,” he said, arguing that the law may not be necessary under a different presidential administration.

CNN —A vigil will be held Monday afternoon for Laken Hope Riley, an Augusta University nursing student who was found dead after jogging on the University of Georgia campus last week, as her suspected killer’s immigration status has drawn the scrutiny of Republican leaders. Riley, who was a UGA student until May 2023, was found dead Thursday near a lake on the university’s campus from blunt force trauma, according to UGA Police Chief Jeff Clark. Riley’s killing has left the University of Georgia to grieve two tragic deaths that occurred less than a day apart: Her body was discovered just hours after the death of a UGA student the previous night. The Monday afternoon vigil will be co-hosted by Riley’s Alpha Chi Omega sorority at UGA in remembrance of both of the dead students, the university said. CNN —A plague on both these houses:The Senate seems to lack the political will for a bipartisan border deal. The House lacks an effective majority for a partisan impeachment effort as GOP leaders scramble for votes. Except, as the vote approached, they seemed to realize they might not have the votes to impeach Mayorkas after all. The only other time a Cabinet member was impeached, back in 1876, it was with a unanimous House vote. With hours to go before the Mayorkas impeachment vote is set to occur, there is a real possibility it could fail, and it can only pass by the slimmest of margins.

WASHINGTON (AP) — The U.S. House is ready to impeach Homeland Security Secretary Alejandro Mayorkas over border security, a deeply partisan and highly unusual attack on a Cabinet official that has drawn concerns from constitutional scholars and rebuke from Democrats. The House vote on the charges, which Democrats say are untrue and hardly grounds for impeachment, is set for Tuesday. “Very clearly Secretary Mayorkas has picked and chosen which laws he's going to enforce,” said Rep. Mark Green, R-Tenn., the chairman of the Committee on Homeland Security, at a hearing ahead of the vote. Green’s committee had been investigating the Homeland Security secretary for much of the past year, but a resolution from Rep. Marjorie Taylor Greene, R-Ga., a Trump ally, pushed it to the fore. Even if Republicans are able to impeach Mayorkas, he is not expected to be convicted in a Senate trial where Republican senators have been cool to the effort.

New York CNN —Federal Reserve Chair Jerome Powell said the time is coming for interest rate cuts, but asked Americans for a bit more patience in the central bank’s fight against inflation. That means the Fed is due to cut rates in 2024, which officials themselves projected in December. But the central bank’s January policy statement pushed back on expectations of the first rate cut coming at their next meeting in March. Still, financial markets see a 20% chance the Fed will cut rates in March and a 71.3% chance they cut in May, according to the CME FedWatch Tool. But that hasn’t stopped Congress from pressuring Powell to cut rates.

The so-called #AbandonBiden campaign began when Minnesota Muslim Americans demanded Biden call for a ceasefire by Oct. 31, and has spread to Michigan, Arizona, Wisconsin, Pennsylvania and Florida. Muslim Americans said they did not expect Trump to treat their community any better if reelected but saw denying Biden votes their only means to shape U.S. policy. It remains to be seen whether Muslim voters would turn against Biden en masse, but small shifts in support could make a difference in states Biden won by narrow margins in 2020. A recent poll showed Biden's support among Arab Americans has plunged from a comfortable majority in 2020 to 17%.
